1. Products

Hair By Ginika specialises in premium raw human hair wigs, raw hair bundles, styling tools, and hair accessories.

Product descriptions, specifications, and images are provided to represent our products as accurately as possible. Due to differences in monitor settings, lighting, and the natural characteristics of raw human hair, slight variations in colour, texture, density, curl pattern, or appearance may occur and do not constitute defects.

Hair lengths are measured from the point where the lace closure or frontal ends to the tips of the hair when straightened.

Layered Units: Layered wigs will measure approximately 2–3 inches shorter than the selected length because the hair is professionally cut to create the layered style. This is an intentional design feature and is not considered a defect.

Blunt Cut Units: Blunt-cut wigs are professionally trimmed to achieve the advertised style. As a result, approximately 2–3 inches of the original hair length are removed. This is intentional and is not considered a defect.

Coloured Units: Each coloured wig is individually custom coloured. Slight variations in shade and tone may occur between units and do not constitute defects.

Head Size: Customers are responsible for providing accurate head measurements when ordering custom-sized wigs. We cannot accept returns or exchanges due to incorrect measurements provided by the customer. Where possible, alterations may be offered at an additional service fee.

2. Orders & Payment

All orders are subject to acceptance and product availability.

Full payment is required before an order is processed or shipped.

We reserve the right to refuse, cancel, or limit any order where fraud is suspected, payment cannot be verified, pricing errors occur, or inventory is unavailable.

If an order is cancelled after payment has been received, a full refund of the amount paid will be issued.

3. Shipping & Delivery

Estimated delivery times are provided for convenience only and are not guaranteed.

We are not responsible for delays caused by shipping carriers, severe weather, customs clearance, incorrect delivery information supplied by the customer, or other circumstances beyond our reasonable control.

Customers are responsible for providing a complete and accurate shipping address. We are not liable for lost, delayed, or misdelivered packages resulting from inaccurate or incomplete address information.

Risk of loss and title to products pass to the customer upon confirmed delivery by the shipping carrier.

4. Returns, Exchanges & Refunds

Customers may request a return of eligible items within 14 days of delivery, subject to the conditions below.

For hygiene and safety reasons, wigs, lace products, and hair extensions may only be returned if they are:

• Unused

• Unworn

• Unwashed

• Free from odours or damage

• In their original condition and packaging

• Have uncut lace

Once the lace has been cut or the product has been worn, altered, washed, coloured, bleached, chemically treated or styled, it is no longer eligible for return or exchange.

Custom-made, personalised, made-to-order or altered products are non-refundable unless they arrive damaged, defective or materially different from what was ordered.

If you receive an item that is defective, damaged or materially different from what was ordered, please contact us within 7 days of delivery. We will review the issue and, where appropriate, provide a repair, replacement or refund in accordance with applicable law.

Orders placed through our Nigerian website or fulfilled directly from Lagos, Nigeria are subject to the return policies applicable to Nigeria and cannot be returned through our US operations.

5. Product Care

Raw human hair requires proper maintenance.

Hair By Ginika is not responsible for damage caused by misuse, improper installation, chemical processing, excessive heat, improper storage, failure to follow recommended care instructions, or normal wear and tear.

6. Limitation of Liability

To the fullest extent permitted by applicable law, Hair By Ginika shall not be liable for any indirect, incidental, special, consequential or punitive damages, including but not limited to loss of profits, loss of business, loss of opportunity, emotional distress or other indirect losses arising from the purchase or use of our products.

Nothing in these Terms limits liability where such limitation is prohibited under applicable law.

7. Intellectual Property

All content on the Hair By Ginika website, including images, product photographs, videos, graphics, logos, branding, text, product descriptions, designs and other materials, is the exclusive property of Hair By Ginika or its licensors and is protected by applicable intellectual property laws.

No content may be copied, reproduced, distributed, modified, published or used without our prior written permission.

8. Governing Law

These Terms and Conditions shall be governed by and interpreted in accordance with the laws of the State of Wyoming, without regard to its conflict of law principles.

Any legal action or dispute arising from these Terms or the purchase of our products shall be brought exclusively in the state or federal courts located in the State of Wyoming, and both parties consent to the jurisdiction of those courts.

9. Disclaimer of Warranties

Except as expressly stated in these Terms or as required by applicable law, all products are provided on an "as is" and "as available" basis without any express or implied warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, title or non-infringement.

Because our products are made from natural raw human hair, normal variations in colour, texture, density, curl pattern and appearance are expected and do not constitute defects.

Nothing in these Terms excludes or limits any warranty or consumer rights that cannot legally be excluded under applicable law.

10. Fraud Prevention & Chargebacks

To protect our customers and business from fraud, we reserve the right to verify the identity of the purchaser before processing or shipping an order. Verification may include requesting government-issued identification, proof of payment or additional information.

Orders identified as potentially fraudulent may be delayed, cancelled or refunded at our discretion.

Customers agree not to initiate a payment dispute or chargeback without first contacting Hair By Ginika to allow us the opportunity to resolve the issue.

Where a chargeback is determined to be fraudulent or unwarranted, we reserve the right to provide supporting documentation to the payment processor, recover any associated costs where permitted by law, refuse future orders and pursue any legal remedies available.

11. Marketing Communications

By subscribing to our mailing list or opting in to receive promotional communications, you consent to receive marketing emails and, where applicable, SMS messages from Hair By Ginika.

Consent to receive marketing communications is voluntary and is not a condition of purchase.

You may unsubscribe from marketing emails at any time by clicking the "Unsubscribe" link included in our emails or by contacting us directly.

If you have opted in to receive SMS messages, you may opt out at any time by following the instructions provided in the message or by replying STOP, where applicable.

We will collect, use and protect your personal information in accordance with our Privacy Policy and applicable data protection laws.

12. Natural Characteristics of Raw Human Hair

Our wigs and hair extensions are made from 100% premium raw human hair. Because raw hair is a natural product, no two units are identical.

The following characteristics are normal and do not constitute manufacturing defects, faults or grounds for a refund or exchange:

• Slight variations in colour, texture, density or curl pattern.

• Minor differences between individual wigs or bundles.

• Natural frizz, flyaways or short hairs.

• Temporary odours from packaging or processing that disappear after washing.

• Normal shedding within industry standards.

• Lace tint variations.

• Minor variations in cap construction that do not affect the functionality or fit of the wig.

• Natural changes in texture after washing, colouring or styling.

These characteristics are inherent to authentic raw human hair and reflect the uniqueness of each product.
